Scientific Conception of the Scientific Laboratory of the Law of Bioethics and Medical LawThe legal aspects of the protection of human rights in the sphere of medicine and biotechnologies are very contemporary for Ukraine especially on the point of Governmental Program of Adoption of the Ukrainian legislation to the legislation of the European Union. The most difficult part of the adoption program concerns the sphere of medicine and biotechnologies. Such difficulties have two main aspects.

The first one is a moral aspect of inability of the Ukrainian society to accept the possibilities of the modern medicine and biotechnology. This problem could not be decided without education programs for the wide circles of the society as well as for the narrow circles of the specialists in the field of medicine, biology and law.
The Ukrainian society should be prepared to provide the public control on protection of human rights in the sphere of medicine and biotechnologies on the point of high moral principles but not clerical dogmas. The first steps have been done. The Academy of Medical Science of Ukraine organized National Congresses on Bioethics on 2001, 2004, 2007 years and on September 2010.
The second one is a legal aspect. Ukrainian legislation has many deficiencies in the sphere of legal regulation of providing the biotechnological researches and, in particular, in the procedure of protection of human rights in the sphere of biotechnologies and medicine. The lack of the domestic norms in the sphere of protection of human rights in biotechnologies could stop the scientific researches in the field of the biology and medicine in Ukraine. Such situation takes place in Ukraine because of the principles of the major international conventions in the sphere of biotechnologies and medicine, which proclaim the necessity of the national regulation of biotechnological researches and protection of human rights in the mentioned sphere, and, in the case of absence of such national law regulation, all the researches in the field of biotechnologies in the biology and medicine should be stopped.
The development of the people’s mentality in the point of exception or rejection of challenges of the progress and modern opportunities in the science in the field of biotechnologies should be reflected in the improvement of the legislation. The experience of Czech Republic in the sphere of protection of human rights in biotechnologies could be successfully applicable for Ukraine.
Scientific Laboratory of the Law of Bioethics and Medical Law of the Kyiv University of Law of NAS of Ukraine is opening for any negotiations and cooperation with any scientific and educational institutions for the common projects in the field of protection of human rights in the sphere of biotechnologies and medicine.
